TERMS & CONDITIONS

These Terms and Conditions govern all sales of products and services provided by TitanTek unless otherwise agreed in writing.

  1. Scope

All quotations, proposals, acknowledgments, invoices, and sales transactions are subject exclusively to these Terms and Conditions. Any conflicting or additional terms proposed by the purchaser are rejected unless expressly accepted in writing by TitanTek.

  1. Quotations and Orders

All quotations are valid for a limited period stated in the proposal and are subject to change without notice prior to order confirmation. Orders become binding only upon written acceptance by TitanTek.

Specifications, dimensions, finishes, and performance details must be reviewed and approved by the purchaser before order confirmation. TitanTek is not responsible for errors resulting from inaccurate or incomplete information provided by the purchaser.

  1. Pricing

Prices are subject to change based on raw material costs, manufacturing conditions, transportation costs, taxes, and other market factors. Unless otherwise specified, prices do not include shipping, installation, taxes, duties, or insurance.

TitanTek reserves the right to adjust pricing in the event of significant cost increases prior to shipment.

  1. Payment Terms

Payment terms will be specified in the quotation or invoice. Failure to make timely payments may result in suspension of production or shipment.

Late payments may incur interest charges at the maximum rate permitted by law. TitanTek reserves the right to recover all reasonable costs associated with collection efforts.

  1. Delivery and Risk of Loss

Delivery dates are estimates only and are not guaranteed. TitanTek shall not be liable for delays caused by manufacturing issues, supply chain disruptions, labor shortages, force majeure events, or transportation delays.

Risk of loss transfers to the purchaser upon shipment from TitanTek’s facility unless otherwise agreed in writing.

  1. Inspection and Claims

The purchaser must inspect products upon delivery and notify TitanTek in writing of any defects, shortages, or damage within a specified timeframe (e.g., 5 business days). Failure to provide timely notice constitutes acceptance of the goods.

  1. Returns and Cancellations

Custom-fabricated or special-order products are non-returnable unless defective. Order cancellations must be requested in writing and may be subject to cancellation fees based on production stage and material procurement status.

  1. Warranty

TitanTek warrants that products will conform to agreed specifications at the time of shipment. Warranty coverage, duration, and limitations will be specified in the applicable product warranty documentation.

The warranty does not cover damage resulting from improper installation, misuse, alteration, negligence, environmental exposure beyond design standards, or failure to follow installation guidelines.

TitanTek’s liability under warranty is limited to repair or replacement of defective products at its discretion.

  1. Limitation of Liability

TitanTek shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, business interruption, or project delays.

Total liability shall not exceed the purchase price of the products supplied.

  1. Force Majeure

TitanTek shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, acts of government, strikes, material shortages, pandemics, or transportation disruptions.

  1. Governing Law

These Terms and Conditions shall be governed by the laws of the applicable jurisdiction in which TitanTek operates, without regard to conflict of law principles.
